Mistrial declared for highway guardrail case due to witness concerns

United States District Judge Rodney Gilstrap declared a mistrial of the case regarding the safety of highway guardrails designed by Dallas-based Trinity Industries, Inc., due to concerns about the honesty of a witness, the Claims Journal reported on July 21.

Gilstrap said he will schedule a new trial date when he meets with the attorneys for both the defense and the prosecution on August 18. The lawsuit was an offshoot of Swords Creek, Virginia resident Joshua Harman’s complaint that instead of acting like a shock absorber when a car hits them, Trinity’s guardrails act like a dangerous spear.

In 2011 Trinity filed a lawsuit against Harman, who formerly owned companies that manufactured and installed guardrail systems, for patent infringement; the case was settled for an undisclosed sum.

Manufacturers are held to a standard of quality and safety, but sometimes, dangerous products still reach the public.
